By contracting this service with Simphony Technologies Group S.A.S., you accept the following:
① We start working immediately
Once payment is made, our team begins building your store from the first business day. We need you to provide: your logo, product photos and descriptions, and your business contact information. If you don't have everything ready, we start with what's available and complete it during the monthly support.
② Shared commitment: 6 months
This service has a six (6) month commitment. Why? Because the cost of designing and building your store (valued between $1,500,000 and $3,000,000 COP) is already included in your monthly plan — we don't charge setup separately. We invest that capital from day 1. If you decide to leave before 6 months, you only pay 70% of what's left (not 100%). For example, if you cancel at month 4 on the Activar plan, you pay ~$700,000 instead of $1,000,000. It's a fair way to share the build cost we already invested. After 6 months, you can cancel anytime with 30 days' notice, no penalty.
③ Your content is yours. The platform is ours.
Photos, texts, customer data and orders from your store are yours and always will be. If the contract ends, we deliver a copy of everything. The technology platform (code, technical design, configurations) is property of Simphony and is not transferred.
④ We do not guarantee sales
We deliver the store, the data and the recommendations. But your business results depend on many factors we don't control (your product, your market, your marketing investment). Monthly reports are professional guidance, not a billing promise.
⑤ Availability: 99.5%
We guarantee your store will be online 99.5% of the time each month. If we fail due to our fault, we credit your next invoice. Downtime from scheduled maintenance, payment gateway failures or events beyond our control don't count.
⑥ Payments and late fees
Billing is automatic each month through the payment gateway. If a charge fails, you have 15 days to catch up. After 15 days without payment, we may suspend your store until you regularize. Suspension does not eliminate the payment obligation during the 6-month commitment.
⑦ Right of withdrawal
Since the service begins immediately with your authorization, the right of withdrawal does not apply (Art. 47, Law 1480/2011, exception 1). If for any reason we have not started working within 5 business days after your payment, you can request a full refund.
⑧ Plan changes
You can upgrade at any time (from Activar to Escalar, for example). Downgrading is only possible after the minimum commitment ends.
